We offer the Website, including all information, tools and services available on the website to you, conditional on your acceptance of all terms and conditions, policies and notices of the Company.
The contents of the Website are the copyright of the Company. You may only access, view and print information for your own personal use.
To the extent permitted by law, we accept no responsibility for any loss suffered in connection with the use of the Website.
We may change the Content and services described on this site at any time without prior notice.
We have made every effort to display as accurately as possible the products available in our online store. However, due to the perishable/seasonal nature of flowers some pictures on the site may vary from the actual product.
If you would like to verify site content or have any specific questions regarding a product or service please contact us via email.
PRODUCTS
Bouquets are created with seasonal flowers and may vary in type and colour used from the website pictures, brochures or advertising.
We reserve the right to provide a reasonable substitution for flowers if they are not available at the time of ordering.
COSTS
The price payable is as stated on the Website or quote provided to you. If your requirements change this may result in a variation to the price.
We reserve our right to claim any costs incurred by us from you including, but not limited to, presentation costs, delivery costs, call out fees, changes requested by the client, re-delivery fees, travel and accommodation. We will endeavour to obtain your consent prior to incurring any extra costs.
LIMITATION OF LIABILITY
Our liability is limited to the value of the goods ordered and paid for by you.
RETURNS AND REFUNDS
Once an order has been completed, we do not accept returns.
We do not offer refunds on dried flowers.
Any refunds (at our discretion) will be refunded in the form of the original payment method used by the buyer.
COMPLAINTS
If you are unhappy with a product provided from us, please phone Kelly directly within 24 hours of receiving the product.
Depending on the circumstances, we may provide an alternative substitute product or refund the price of the product
We reserve our right to determine this on a case by case basis in our complete discretion.
ONLINE ORDERS AND PAYMENT
.All online orders can be paid securely through Stripe. 20. All prices stated on the website are in New Zealand Dollars (NZD), inclusive of 15% GST.
All prices are exclusive of delivery fees which will be calculated at the time of check out.
We reserve the right to change prices at any time. The price of orders already placed and accepted will not be altered unless agreed.
We reserve the right to cancel or decline any order made through our website or over the phone. Any moneys paid for cancelled or declined orders will be repaid in full.
DELIVERIES
We do not offer same-day delivery on our products. 25. You must place orders for delivery no later than 24 hours prior to delivery date.
In emergency situations please contact Kelly at 027 975 5517 for same day delivery, this is based solely on our availability and discretion.
We will try our best to deliver any product within the time frames we indicate to you. Any product that is rejected by the recipient, the address provided is not correct or complete, the recipient is not at the address specified or it is unsafe to enter the address is for all intents and purposes considered effective delivery and no refunds, credits or returns will be provided.
If the recipient is not at the address specified when the delivery is made, we will do our best to leave the product in a safe location. If we leave the delivery in what we believe to be a safe location, we will not be liable if it goes missing or is lost or damaged. We will take a photo of the delivery where we have left it, this photo can be requested by the Customer.
PRIVACY
We collect personal information from you, including information about your; name, contact information, location, billing or purchase information.
We collect your personal information in order to take orders and payments.
Providing some information is optional. If you choose not to enter personal and payment details, we'll be unable to produce and deliver our product.
You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. If you’d like to ask for a copy of your information, or to have it corrected, please contact us.
COVID19 AND OTHER EMERGENCIES
If we are unable to operate due to COVID19 or any other national or regional emergency we will inform you and either arrange for a refund or postpone your order.
To ensure safety of our customers and staff, we will be following public health guidelines.
Flowers can be picked up by you at our address at an arranged time. Orders and payments will need to be completed over the phone or online in the event that public health guidelines require social distancing.
Due to COVID19 and other national or regional emergencies there will be shortages of some varieties of flowers, and this will change on a daily basis subject to market availability.
WEDDINGS
All weddings and large-scale events require a 50% non-refundable deposit to be paid at the time the contract is accepted.
The precise content of the proposal with regard to colour, floral variety, and creative direction, remains a fluid collaboration between the Company and the client up until two months prior to the date of the event. This proposal will be considered the fixed price of the order. Any changes to the order after such time will incur an additional charge of $50 per change.
All changes must be sent via email to kelly@hand-picked.co.nz.
The balance of the agreed price is due 14 days prior to the event. In the event of cancellation, all payments made are non-refundable.
Where specific varieties of flowers are defined, Hand-Picked Flower Company reserves the right to make substitutions of flowers of equivalent value and variety whenever market conditions, weather, or availability affect the integrity of the flowers in the proposal.
It is understood that HAND-PICKED FLOWER COMPANY will act as the sole and exclusive florist for your event. By agreeing to this contract The Client agrees that no other person, company, Friend, Family Member, professional or otherwise, shall provide fresh, dried or artificial floral products for The Client’s event location or event reception without the consent of Hand-picked flower company. This clause is to protect the image of Hand-picked flower company from assumptions that might occur from the event’s attendees. Some exceptions may apply, inquire with Kelly, owner and lead Designer at Hand-picked flower company.
In the event your wedding must be postponed or cancelled due to COVID19 or other national or regional emergencies we require a minimum of four weeks’ notice. Weddings postponed for longer than six months will be re-priced.
All postponed weddings incur a $100 inclusive of GST administration fee.
